November 15, 2017

Gaughan called the work session meeting to order at 4:00 p.m. on Wednesday, November 15, 2017 with all members present.

CONSENT AGENDA 11-15-17

Gaughan moved approval of the following Consent Agenda:

►  Commission orders 17-043, 17-044 and 17-045 (on file in the County Clerk’s Office); and

► Acquisition of Easements for construction project no. 023 C-4857-01/20015-17 with the following property owners: Marcus Jones, Dawn Jones, Jordan Jones and Evinder Jones, 1984 N 100 Road, Eudora, Tract No. 23; Gregory R. Stephens, 1003 E 2000 Road, Eudora, KS, Tract No. 25; and  Patrick T. Halpin and Erin E. Callahan-Halpin, 981 E 1549 Rd, Lawrence, KS, Tract No. 26

Motion was seconded by Thellman and carried 3-0.

PUBLIC WORKS 11-15-17

The Board considered approval of an agreement to relocate RWD No. 4 water lines for Route 458 roadside safety improvements from E 1800 Road to E 2000 Road; DGCO Project No. 2015-17; KDOT Project No. 23 C-4857-01. Keith Browning, Director of Public Works, presented the item. 

The CIP includes $950,000 for a project for roadside safety improvement on Route 458 from E 1800 Road to E 2000 Road with proposed cost at $915,000. This project was approved for HRRR (High Risk Rural Roads) federal funding through KDOT which will cover about 90 percent of the safety enhancements.

The Commission was asked to consider the Utility Relocation Agreement between RWD No. 4 and Douglas County which stipulates Douglas County will be responsible for all actual costs for the full waterline relocations estimated at $330,014.

After discussion, Gaughan moved approval of a Utility Relocation Agreement with Rural Water District No. 4 for waterline relocations associated with Project No. 2015-17, roadside safety improvements and pavement rehabilitation on Route 458 from E 1800 Road to E 2000 Road. Motion was seconded by Thellman and carried 3-0.

 

ACCOUNT PAYABLE 11-15-17

Gaughan moved to approve accounts payable in the amounts of $919,212.13 paid on 11/16/17, $207,516.34 to be paid on 11/02/17, $33.48 paid on 10/27/17, and $625.38 and $291,033.66 paid on 10/26/17. Motion was seconded by Derusseau and carried 3-0.

 

APPOINTMENT 11-15-17

Derusseau moved to appoint Phil Metsker to the Board of Zoning Appeals for a three-year term to fill the expired term of Kay Hodge. Motion was seconded by Thellman and carried 3-0.

MISCELLANEOUS 11-15-17

Derusseau stated she has concerns about the article in the Journal World regarding the state authorizing the City of Lawrence to release millions of gallons of nitrogen-contaminated water from the former Farmland plant into the Kansas River.

Thellman said she has received emails from concerned citizens. Though the release is not a long-term solution, Thellman stated the City of Lawrence needs to explain their long term plan.

MISCELLANEOUS 11-15-17

Gaughan stated he has been contacted by a local massage therapist concerned about new regulations and the effect on legitimate operations. According to Gaughan, the District Attorney is seeing an increase in human trafficking cases surrounding massage businesses that appear to have moved in from Johnson County.

MISCELLANEOUS 11-15-17

Thellman stated there has also been a surge of salt water injection well applications in Douglas County. There will be an organized meeting to better understand these types of wells on November 20 at 7 p.m. in the Flory Building at the Douglas County Fairgrounds.

Gaughan moved to adjourn the meeting. Motion was seconded by Thellman

and carried 3-0.
