Flory called the regular meeting to order at 4:00 p.m. on Wednesday, September 9, 2015 with all members present.

Flory moved approval of the minutes for July 22, July 29, August 5 and August 26, 2015. Motion was seconded by Gaughan and carried 3-0.
CONSENT AGENDA 09-09-15

PLANNING/CUP 09-09-15
The Board considered CUP-15-000165, a Condition Use Permit for Hamm Eudora Quarry No. 68, 1232 E 2300 Road for a revised reclamation plan for the current phase to allow stockpile of product. Mary Miller, Lawrence-Douglas County Metropolitan Planning Staff, presented the item.
The CUP was approved by the Board of County Commissioner on July 9, 2014 subject to conditions and restrictions of use. The decision before the County Commission was to consider the approval of the modification to the reclamation plan. The proposed reclamation plan would allow approximately five acres of the current phase of the quarry, to be used for stockpiling of product on the land that has been graded. The application of top soil and seeding will occur following the conclusion of quarrying activities on the property. The stockpiled area will be reclaimed in conjunction with the reclamation of the operation area on the Hamm owned property, the Petefish Quarry, west of Coleman Creek. Staff recommends approval of the reclamation plan. However, there is a secondary issue related to dust brought to staff by surrounding neighbors.
Miller said she received an email from Jim Gabriel concerning dust issues on the road. She said have been calls about truck traffic on E 2300 Road.
Regarding the dust issue, Keith Browning, Director of Zoning and Codes, stated he is willing to post commercial signs with a 5-ton weight limit on E 2300 Road to discourage truck traffic there, study speeds on N 1200 Road
and possibly post a reduced speed limit if appropriate. Hamm Quarry has agreed to pay to have dust palliative applied to all of N 1200 Road from E 2200 (County Route 1061) to the East Quarry entrance one time a year. If any additional applications would required during that year it would be paid for from the road maintenance fee.
Browning stated Hamm has treated sections of the road twice, but there are gaps where it is dusty. The cost to treat the entire road is $11,000 for material. The County will make the decision on whether the road needs another treatment. We can utilize the ton fee, which goes to Douglas County for road maintenance. Hamm also provides rock for the township for the road and the water needed to prep the road for treatment.
Thellman asked if the truck traffic was getting off the prescribed route and using E 2300 Road. Browning suggested the 5-ton limit would keep trucks from using E 2300 Road. The sheriff’s office will have to enforce the 5-ton limit. The CUP does say that trucks will use N1200 Road, but it was not explicit that truck would not use E 2300 Road. The 5-ton limit will make that explicit.
Browning will bring a resolution to the Board regarding the truck weight limit. He will go ahead and put the signs up.
Flory opened the item for public comment.
Caren Rowland, 12157 E 2300 Road, stated the trucks going down her road causes excessive dust and her husband has health issues. She said she is “ok” with the 5-ton limit if that cuts down on the truck traffic. Browning responded the County will be adding four weight limit signs.
Jim Gabriel, 2267 N 1200 Road, said the asphalt plant brings in trucks all times of the day. He asked what happens after the township blades the road and plows up the dust palliative. Browning stated if that happens, the roads will have to be touched up. Gabriel also complained about the trash the truck drivers are throwing in the ditches.
John Strome, Hamm, stated they have supplied dust control three times this year. He was not aware of trucks on E 2300 Road until a week ago. Hopefully the 5-ton limit will eliminate most of those concerns about E 2400 Road. He is trying to come up with ways to address the neighbors concerns.
Gabriel asked about the hours of operation. Flory responded the asphalt plant works Monday through Saturday. There is a provision that would enable the owner to ask for extra hours but that would have to be approved by the County Commission.

ACCOUNTS PAYABLE 09-09-15
Flory moved to approve accounts payable in the amount of $311,786.99 to be paid on 09/10/15. Motion was seconded by Thellman and carried 3-0.
