Charge Filed in Property Damage Case

February 24, 2017 10:49 am

On December 9, 2016, Lawrence Police Department officers were dispatched to a report of property damage at 545 Wisconsin Street, Lawrence, Kansas.  Upon arrival, officers contacted a female who claimed the car she was driving had been damaged by a known person and other unknown individual(s).

Upon investigation officers determined that the female had been inside the Yacht Club, 530 Wisconsin, earlier in the evening.  Upon leaving the female threw a drink on a male patron. A friend of the male patron, identified as Joshua Jackson followed the female to her car and engaged in an argument with the female.  While the female and Jackson were engaged in the argument, the female’s car was damaged in several places.

During the argument witnesses claimed to have observed Jackson kick the driver’s door of the vehicle and kick a rear taillight causing damage.  During the argument other unknown individual(s) caused damage to the vehicle.  The damage to the vehicle for all damage was estimated to be $3,150.45.  Witnesses at the scene were unable to specifically identify other individual(s) that caused damage to the vehicle other than Jackson.

The value of damage to the door and taillight was estimated to be $1,127.45.  The State has requested a summons be issued for Jackson to appear in court for criminal damage to property less than $1,000, a class B non-person misdemeanor.  Felony criminal damage (damage in excess of $1,000) was not charged because the State cannot prove beyond a reasonable doubt that all the damage to the door and taillight were caused by Jackson due to other unidentifiable individual(s) damaging the vehicle.

All defendants are presumed innocent until and unless proven guilty.  Charges are merely allegations of criminal conduct.
