 (b) Consider approval of Budget Adjustment for the 2018 Adult Community Corrections Grant in the Amount of $5,610.48;

 (c) Consider approval of Budget Adjustment for the 2018 Juvenile KDOC Grant Amount TBD when we receive The Children’s Shelter Information; and

 (d) Approve of FY 2019 Community Corrections Grant Funds Revised Budget Summary and Budget Narrative due to Adult Community Corrections FY 2019 budget cut in the amount of $9,891.09.

(3) Executive Session for the purpose of consultation with County Counselor on matters, which would be deemed, privileged under the attorney-client relationship. The justification is to maintain attorney client privilege on a matter involving Douglas County.

July 25, 2018

Thellman called the regular meeting to order at 4:00 p.m. on Wednesday, July 25, 2018 with all members present.

CONSENT AGENDA 07-25-18

Thellman moved approval of the following Consent Agenda:

►  Commission Order No. 18-035 on file in the office the County Clerk); which includes approval of real property disaster relief pursuant to K.S.A. 79-1613 for the following property owners: Clark A. Sexton, PIN 023-067-35-0-30-03-017.00-0; August J. and Chala J. LaRocca, PIN 023-067-26-0-30-06-006.00-0; and James V. and Gayla B. Bieker, PIN 023-112-10-0-10-10-013.00-0.

► Budget Adjustment for the 2018 Adult Community Corrections Grant in the Amount of $5,610.48; and

► FY 2019 Community Corrections Grant Funds Revised Budget Summary and Budget Narrative due to Adult Community Corrections FY 2019 budget cut in the amount of $9,891.09.

Motion was seconded by Derusseau and carried 3-0.

EXECUTIVE SESSION 07-25-18

Thellman moved that the Board of County Commissioners recess into executive session with the County Counselor, County Administrator, Assistant County Administrator, and Pam Weigand, Director of Youth Services, to discuss matters relating to the Douglas County Department of Criminal Justice Services, pursuant to the attorney-client privilege exception in K.S.A. 75-4319(b)(2), returning to this room at 4:35 p.m.

At 4:35 p.m., Thellman moved to extend the executive session for 10 minutes, returning at 4:45 p.m. Motion was seconded by Gaughan and carried 3-0.

At 4:45 p.m., Thellman moved to extend the executive session for 10 minutes, to returning at 4:55 p.m. Motion was seconded by Gaughan and carried 3-0.

At 4:55 p.m., the Board returned to regular session. No action was taken.

ACCOUNT PAYABLE 07-25-18

Thellman moved to approve payroll in the amounts of $509,035.25 to be paid on 07/26/18, and $2,327.83 paid on 07/19/18; and payroll in the amounts of $1,023,945.46 paid on 07/06/18 and $1,057,181.99 paid on 07/20/18. Motion was seconded by Gaughan and carried 3-0.

PUBLIC COMMENT 07-25-18

Ron Wilson, 627 N 650 Road, stated he questions why we are housing people in our jail from outside our county and sending inmates to other facilities. Craig Weinaug, County Administrator, responded that the responsibility of jurisdiction for inmates is determined by where the offense occurred. If the crime was committed in Douglas County, the inmate is held in Douglas County. Inmates are frequently farmed out to other facilities due to overcrowding. The location is based on who has availability, who they will take and when the hearing dates are scheduled.

Wilson added he agrees with a comment made at the last meeting that inmates should have a physical outlet, but abuse of that privilege and equipment should not be tolerated.

Wilson also stated he wants to know why his three complaints to the county have not been investigated. He said he received an email stating the Board is aware he has filed the complaints. Derusseau responded she sent an email response to Wilson regarding the complaints on Thursday, July 19 surrounding shooting at the firing range. She forwarded the email from the Fraternal Order of Police regarding the September 30, 2017 complaint which was investigated, explained and resolved; the two complaints from April 2018 regarding early morning firing have been addressed. Law enforcement officers are allowed to train during that time frame under the Conditional Use Permit. 

Thellman moved to adjourn the meeting. Motion was seconded by Gaughan and carried 3-0.
