The Board considered the approval of a change for 911 phone service provider.
Randy Roberts, Director of Emergency Communications, presented the background information the three options for 911 provider systems available to Douglas County: State NG-911, Mid-American Regional Council (MARC) or remain as a stand-alone center as we are currently operating. Staff recommends the MARC regional 911 group which shares the cost by all members based on individual county population. Currently Douglas County is rated at 6% of the regional share ($25,000 per month, $300,000 annually). The annual fees with MARC cover complete 911 associated equipment replacement costs as well as any other associated expenses for the 911 system. The membership also guarantees 24/7 service of all 911 operational needs for the center. MARC service techs are located within a 45-minute physical response area, as well as remote access to the system.
The Mid America Regional Council currently covers 9 counties, and 119 cities in both Kansas and Missouri. There are currently 44 Communication Centers (PSAPs) in the MARC Regional 911 group. The 911 Centers in Kansas include Kansas City, Johnson County, Leavenworth, Leawood, Lenexa, Miami County, Overland Park, Prairie Village, Shawnee, and the Unified Government of Wyandotte County Kansas. Franklin County is currently in negotiations with MARC.
Thellman opened the item for public comment. No comment was received.
After discussion, Thellman moved to authorize the Sheriff and Emergency Communications Director to enter into agreements with the Mid America Regional Council to provide 911 services for Douglas County, and discontinue the existing service agreement with Commenco, Inc. Motion was seconded by Derusseau and carried 3-0.

Britt Crum-Cano, Economic Development Coordinator with the City of Lawrence, made a presentation to the Board on the 2017 Annual Report: Economic Support & Compliance.

Thellman moved to approve payroll in the amount of $1,072,897.94 to be paid on 05/03/18. Motion was seconded by Gaughan and carried 3-0.
APPOINTMENT 05-02-18
Thellman moved to appoint Craig Weinaug to the East Hills Board of Trustees. Motion was seconded by Gaughan and carried 3-0.

Thellman moved to approve the following appointments to Fire District No. 4: reappoint Steve Lewis for a three-year term expiring 01/18/21; and Phillip Metsker to a three-year term ending 01/01/2020. Motion was seconded by Gaughan and carried 3-0.

ZONING & CODES 05-02-18
The Board considered the approval of CUP-18-00021, a Conditional Use Permit for an Event Center space for O’Connell Youth Ranch, located at 1623 N 1320 Road. The application was submitted by O’Connell Youth Ranch Inc., property owner of record. Becky Pepper, Lawrence-Douglas County Metropolitan Planning Staff, presented the item.
The subject property is zoned A (Agricultural District). The proposed use for a recreational facility is permitted in that district with the approval of a CUP. Section 12-319.411 of the County Zoning Regulations for the incorporated area lists recreational facility as a permitted use under a CUP. A separate Conditional Use Permit was previously approved to permit the Non-profit, Religious, Educational and Philanthropic Institution use on the subject property (O’Connell Youth Ranch).
According to staff, they received one general inquiry into the proposed project and one specific inquiry as to the location of the event center to determine if it would interfere with future relocation plans of N 1300 Road. After discussing the project in more detail with these individuals, they did not provide any further concerns or comments.
Staff recommended approval of the CUP for an event center space at O’Connell Youth Ranch based on the following findings of fact:
I. Zoning and use of property nearby. The area is at the eastern boundary of Lawrence and is a mix of urban/rural lands and uses. Residential land uses are the predominate uses in this area, with detached dwellings and townhomes being located within the City of Lawrence and group homes on large parcels, with associated accessory uses, including agriculture on properties outside the city limits. The proposed request will not alter the base zoning or land use of the area.
II. Character of the area. The area contains a blend of urban/rural uses, with O’Connell Road being a general demarcation line between the two types of uses. Urban residential is the predominate use on the west side of O’Connell and rural residences and rural group home facilities are the primary uses on the east side.
III. Sustainability of subject property for the uses to which it has been restricted. The property is suitable for the uses which are permitted within the A (Agricultural) District. The property is also well suited for an event center, a Recreation Facility use. The proposed location of the event center, an existing structure, is located approximately 800 ft. from the adjacent roadways. In addition, the structure is screened from view from these roadways by stands of existing mature trees.
IV. Length of time subject property has remained vacant as zoned. County Zoning Regulations were adopted in 1966; this property has been zoned “A (Agricultural)” since that adoption. This property is not vacant, but has been used as a group home since the approval of the Conditional Use Permit in 1975.
V. Extent to which removal of restrictions will detrimentally affect nearby property. The proposed use is compatible with the surrounding area and will not detrimentally affect nearby properties.
VI. Relative gain to the public health, safety and welfare by the destruction of the value of the petitioner’s property as compared to the hardship imposed upon the individual landowners. In staff’s opinion, there would be no gain to the public health, safety and welfare by the denial of the request. Approval of the request would allow an existing structure to be used as an event center. The applicant has indicated revenue generated from the event center will supplement operations at the O’Connell Youth Ranch. Denial of the request limits the scope of the business for this site.
VII. Conformance with the comprehensive plan. A Conditional Use Permit can be used to allow specific uses that are not permitted in a zoning district with the approval of a site plan. This tool allows development to occur in harmony with the surrounding area and to address specific land use concerns.

Thellman moved to approve the Conditional Use Permit (CUP-18-00021) for an Event Center space at O’Connell Youth Ranch, located at 1623 N 1320 Road. Motion was seconded by Derusseau and carried 3-0.
