Thellman called the regular meeting to order at 4:00 p.m. on Wednesday, April 18, 2018 with all members present.
CONSENT AGENDA 04-18-18
Thellman moved approval of the following Consent Agenda:
► Commission Order Nos. 18-019, and 18-020 on file in the office the County Clerk);
► Approve 7th Judicial District Kansas Department of Corrections-Juvenile Services Juvenile Justice Comprehensive Plan Grant Application for FY 2019;
► The FY19 Kansas Department of Corrections 7th JD Community
Corrections Comprehensive Plan Grant Application;
► The FY19 Kansas Department of Corrections 7th JD Behavioral Health Grant Application;
► Reject all bids for Project No. 2018-52, bridge painting, due to all bids exceeding 100% of the Engineer’s Estimate;

Motion was seconded by Gaughan and carried 3-0.
UPDATE ON WOMEN’S SUBSTANCE/DIVERISON PROGRAMS 04-18-18
Sandra Dixon, Director of DCCCA; and Charles Branson, District Attorney, gave an update to the County Commission on the Women’s Substance and Diversion Program.
Branson said the Women’s Substance Abuse Disorder Prosecutor Lead Division Program was formed because of an increase of female jail population. The reasons behind the increase was largely because of substance use disorders and failure on pretrial release or probation.
The Prosecutor Lead Pretrial Diversion Program is aimed at this propulsion to hopefully divert from the jail and get therapeutic treatment. If successful, charges will be dismissed. What is unique about this target population is we expect the participants to have prior convictions. Branson said we are expanding the diversion programs offered since 1978 to include tougher cases. The target population is female, 18 years or older, Douglas County resident, non-violent with misdemeanor felony and/or drug offenses, and have failed treatment in the past because of their substance abuse disorders.
Candidates are screened by the Sheriff’s office Reentry Program when they are booked in at the jail. Reentry will contract the DA with candidates. If determined the candidate meets all criteria, the DAs office will contact DCCCA for a substance use disorder assessment and determine a treatment level. While this is happening, we’ve created a panel of defense attorneys to be a go-between for services. Once a defense attorney is appointed to the candidate, the judge or the attorney will make contact with the inmate at the jail to see if they are interested in the program. If agreed and accepted in the program, the inmate is released to go into the diversion program. Some of the agency partners include: Lawrence-Douglas County Housing Authority, Criminal Justice Court Service, Friends of Recovery, Bert Nash, and the University Of Kansas School Of Social Welfare.
Branson stated currently two applicants have been screened for the program. One applicant was denied due to drug distribution, and one qualified and started the program.
Dixon stated that though the program is working with its first candidate, she plans to see 8-9 people go through the program this year. The current candidate is on an ankle bracelet because she is a flight risk.
Gaughan asked how this program differs from the diversion program offered to other inmates. Branson said typically the other diversion programs are not supervised by the DAs office and require extensive staff time. This program is resource heavy, much like the behavioral health court. To handle these cases on a weekly basis, it takes an assistant district attorney upwards of 10 hours per week to do the reviews, screens and to go to hearings, then there is support time of 10-15 hours per week.
Gaughan asked if there is a cost to the candidate to participate. Branson said there is no cost. Branson clarified there are no application or screening fees. However, there could be could be court costs if the person was convicted in a court case and attorney fees. Branson said he has talked with Judges about using the waiver of those fees as an incentive to complete the program. These are costs to the County and State. Gaughan said he would also like to look at the existing diversion program fees.
Gaughan asked how it is decided when someone has failed. Dixon said there are two nonnegotiables: posing a threat or is a danger to self. The candidate is required to be actively engaged.
Branson said a treatment failure would be a reason to revoke the diversion, and new law violations.
No action was taken.
REAL ESTATE CONTRACT 04-18-18
After receiving no public comment, Thellman moved to approve a real estate contract with Bert Nash to provide a site for the proposed Behavioral Health Campus commonly described as 1000 W 2nd Street, Lawrence, Kansas. Motion was seconded by Gaughan and carried 3-0.
HEALTH INSURANCE UPDATE 04-18-18
Sarah Plinsky, Assistant County Administrator, brought 2018-2019 Health Insurance Plan revisions to the Board for consideration.
The current plan year has had 23 claimants over $50,000 with a total of $2,225,366 in paid claims, after a stop loss reimbursement of $105,538. There has been a three year trend of large claims experience that has impacted our Stop Loss Insurance renewal. Douglas County has changed stop loss providers from AIG to Tokio Marine HHC; switched provider networks from Network Select to Cigna; increased prescription drug co-pays and added a new telemedicine service with no co-pay. Plinsky provided five plan options to the Commission.
Plinsky stated she consulted with employees about the 2018-2019 plan year who after discussion recommended Option 1 plan changes. Option 1 has the standard prescription drug co-pay with a deductible increase for six high-end prescription drugs, an increase of $50 in deductibles and medical maximum out-of-pocket expenses. These changes will lower premium increases from 10.1% to 8.6%. At this time, staff is not recommending adding bariatric coverage to the plan.
Thellman opened the item for public comment. No comment was received.
Thellman moved to approve modifying the 2018-2019 Health Plan in accordance with staff recommendation for Option 1. Motion was seconded by Derusseau and carried 3-0.
ACCOUNT PAYABLE 04-18-18
Thellman moved to approve payroll in the amounts of $694,804.15 to be paid on 04/19/18 and $311.43 paid on 04/13/18; and payroll in the amounts of $1,013,875.46 paid on 03/30/18, $1,167.69 paid on 03/16/18, and $1,027,327.45 paid on 04/13/18. Motion was seconded by Derusseau and carried 3-0.
APPOINTMENT 04-18-18
Thellman moved to appoint Steve Splichal to the Mental Health Board for a first term ending 04/31/2022. Motion was seconded by Derusseau and carried 3-0.

Thellman moved to appoint the following members to First District No. 2 Board of Directors: David Brown, Richard Anderson and Sue Drew for a first three-year term; and Bill Start to a second three-year term. Motion was seconded by Derusseau and carried 3-0.
