Submitted by B.G. Consultants, Inc. Planning Commission recommended denial on 6/23/14, City Commission returned to Planning Commission on 12/08/15. The revised Comprehensive Plan Amendment has been reduced in scope; retaining the request to reclassify approximately 13.5 acres from Residential/Office to Office/Research but removing the request to include adjacent parcels for additional residential land use. Adopt on first reading, Joint City Ordinance No. 9220/County Resolution No. ____, for Comprehensive Plan Amendment (CPA-14-00005) to Horizon 2020 Chapter 7: Industrial Land Use, and Chapter 14: Specific Plans – K-10 & Farmer’s Turnpike Plan to revise the Future Land Use map. Flory called the regular meeting to order at 4:00 p.m. on Wednesday, April 20, 2016 with all members present.
PROCLAMATION 04-20-16
Thellman moved to approve a proclamation declaring May, 2016 as “National Preservation Month” in Douglas County, as presented by Jan Shupert-Arick, Heritage Conservation Council (HCC) Coordinator. Motion was seconded by Gaughan and carried 3-0.
CONSENT AGENDA 04-20-16
Flory moved approval of the following Consent Agenda:
► Acquisition of Easement for drainage structure no. 4.17N-9.00E for Project No. 2015-53, Road No. 29/76 (E900 Road) with owners: Clinton Charles and Ashley S. Hornberger of Baldwin City for Tract No.1; and C-Ho Farms Inc. of Baldwin City; Tract No. 2.
Motion was seconded by Gaughan and carried 3-0.
BERT NASH 04-20-16
The item to consider a request from Bert Nash for supplemental 2016 funding to facilitate hiring a psychiatrist was tabled.
PLANNING 04-20-16
The County Commission considered approval of a Comprehensive Plan Amendment, CPA-14-00005, to Horizon 2020 Chapter 7: Industrial Land Use, and Chapter 14: Specific Plans – K-10 & Farmer’s Turnpike Plan to revise the Future Land Use map. The application was submitted by B.G. Consultants, Inc. on behalf of the property owner, currently Garber Enterprises, Inc. Jeff Crick, Lawrence-Douglas County Metropolitan Planning Staff, presented the item
The Planning Commission recommended denial on 6/23/14. The City Commission returned the item to the Planning Commission on 12/08/15. The revised Comprehensive Plan Amendment has been reduced in scope; retaining the request to reclassify approximately 13.5 acres from Residential/Office to Office/Research but removing the request to include adjacent parcels for additional residential land use. The City adopted the item on first reading approving Joint City Ordinance No. 9220/County Resolution No. 16-09, for Comprehensive Plan Amendment (CPA-14-00005) to Horizon 2020 Chapter 7: Industrial Land Use, and Chapter 14: Specific Plans – K-10 & Farmer’s Turnpike Plan to revise the Future Land Use map. The Planning Commission approved the item 03/21/16 with an 8-0 vote. .
The land is currently being utilized for agricultural uses. Westar presently operates a utility substation adjacent to the requested area. Additionally, Westar received a Conditional Use Permit (CUP-14-00167) allowing for the expansions of the existing substation to meet the existing and anticipated needs of its users. Planning Staff also recommends revising the Westar Substation property to the Office/Research future land use designation to be consistent with the K-10 & Farmer’s Turnpike Plan.
Staff recommends approval of this amendment.
After discussion, Flory opened the item for public comment. No comment was received.
Flory moved to approve the joint City Ordinance No. 9220 and County Resolution No. 16-09 amending Horizon 2020, The Comprehensive Plan for the City of Lawrence and unincorporated Douglas County, “Chapter 7 – Industrial and Employment related Land Use.: to include additional industrial land, and “Chapter 14-Specific plans,” to revise therein the “K-10 and Farmer’s Turnpike Plan,” to designate, as office/research land use, the additional industrial land, by adopting and incorporating herein by reference “K-10 and Farmer’s Turnpike Plan, April 2016 Edition,: as prepared and published by the Lawrence-Douglas County Metropolitan Planning Office of the City of Lawrence, Kansas. Motion was seconded by Thellman and carried 3-0.
SUSTAINABILITY 04-20-16
The Board considered the authorization of a subcontract and Memorandum of Understanding with Lawrence-Douglas County Health Department and the Sunrise Project. Helen Schnoes, Food Systems Coordinator, presented the item.
Through collaboration with the LiveWell Lawrence community health coalition and the Lawrence-Douglas County Health Department, the Douglas County Food systems and Sustainability Coordinators have developed a project proposal to leverage multiple grant streets to support an experimental pilot project focused on health equity and local food policy. The Lawrence Community Food Alliance, operating as Sunrise Project, was identified as a sole source provider to oversee the project because they oversee a number of community-based programs that build capacity and further personal and community development around food production and social services. This project requires no expenditure of county funding. It is a sub-award under our CDC Partnership to Improve Community Health Grant.
The Sunrise Project will recruit 10 community members beginning May 1, 2016 for employment June 2016 through December 2016. Their job is to help shape food policy by learning about the local food system, participate in a leadership and local government orientation, design and lead neighborhood gatherings, and collaborate with the Douglas County Food Policy Council on a food plan.
Flory opened the item for public comment. No comment was received.
Flory moved to waive the purchasing requirements as part of a sole source process, and approve a Memorandum of Understanding with the Lawrence-Douglas Health Department and sunrise Project; and enter into a sub-contractual agreement with the Sunrise Project for $10,640 of funding from the CDC Partnership to Improve Community Health cooperative agreement. Motion was seconded by Thellman and carried 3-0.
ACCOUNTS PAYABLE 04-20-16
Flory moved to approve accounts payable in the amount of $417,330.05 to be paid on 04/21/16. Motion was seconded by Thellman carried 3-0.
MISCELLANEOUS/PUBLIC COMMENT 04-20-16
John McDermott, Pastor at Morning Star Church representing Justice Matters stated the Board of Justice Matters approved several items they would like the County Commission to consider taking action on, those being: 1) for the County Commission to add someone with expertise on race issues to the CJCC; and 2) for Douglas County to hire a consulting firm approved by the Justice Matters organization to study community corrections data and make recommendations to the CJCC on reducing incarcerations.
Flory responded there will probably be a number of areas in which the CJCC may want more expertise. They have only met once. As they explore the issues and feel there is an area they need particular expertise they have latitude to seek them out. Regarding hiring a consultant, the County has engaged in experts to study data and create reports, information we can use to improve the criminal justice system, which has been one of our goals from the start.
Randy Grable, Justice Matters member, stated he has read the study submitted by the firm the County used and finds no fault with the study, but feels it is narrow and there are other ways to divert people from jail.
Gaughan responded the County Commission may be asked by the Council to hire a full time experienced member with a level of expertise to support the work of the council, but he is not sure when that will happen. Whether they come on as a consultant or full time staff, Gaughan said he is open to both or a combination thereof.
Thellman added the CJCC is a high level group of individuals of which she has great faith in their abilities. She trusts the group to ask for assistance when appropriate.
Flory moved to adjourn the meeting. Motion was seconded by Thellman and carried 3-0.
