Thellman called the special joint meeting to order at 4:00 p.m. on Wednesday, August 20, 2014, with all three members of the Douglas County Commission, the City of Lawrence Commissioners, and the School Board for USD 497.
The following items were presented:

PUBLIC WORKS 08-20-14
Gaughan moved to authorize the BOCC Chair to sign an agreement with KDOT to assume ownership and maintenance responsibilities of old US-59
US-59 freeway construction project. Motion was seconded by Flory and carried 3-0.

Keith Browning, Director of Public, asked the Board to consider allowing the Public Works department to rent out the newly completed Lone Star Lake (LSL) Community Building.
The total building capacity is 59, with the meeting room at 48. Eventually, reservations would be turned over to the Douglas County Maintenance Department who takes the fairground reservations. Browning proposed the following parameters for reserving the LSL Community Building:
1. Cost is $20/hour with a 4-hour minimum
2. Earliest reservation is 9:00 AM; building will close by 8:00 PM
3. Only one event/reservation per day
4. Require $100 clean-up/damage deposit
5. Douglas County Maintenance Dept. will handle reservations
6. Camp host will unlock & lock building, and we will pay him $20/event (for duties not currently included in his contract)
7. Parks Division personnel will clean building following the event (typically the following work day)
8. For Friday events prior to other scheduled weekend events, Camphost will perform minor cleaning duties. We will pay him $25/hour (for duties not currently included in his contract), if cleaning is needed.
The Board discussed extending the summer hours to 9:30 p.m.; adding a sign in the park that gives rental contact information; limiting alcoholic beverages in the building to “own consumption” only; and payment of $20 to camp host to open and close each rental event, $25 with minor cleanup.
Thellman opened the item for public comment. No comment was received.
Thellman moved approval to offer to the public the ability to reserve the Lone Star Lake community building, to adopt the above listed regulations with revisions to include: extending the summer hours to 9:30 p.m.; adding a sign in the park that gives rental contact information; limiting alcoholic beverages allowed in the LSL building as “own consumption” amount only; and paying $20 to the camp host to open and close rental event, or $25 with minor cleanup; and authorize the Public Works to purchase tables and chair for the community building from the Special Park & Recreation Fund in the amount of $3,100. Motion was seconded by Flory and carried 3-0.
ZONING & CODES 08-20-14
The Board considered the approval of a Temporary Business Permit for a temporary borrow pit to be location at the southwest corner of E 1600 Road and N 1175 Road at approximately 1171 E 1600 Road, southwest of the City of Lawrence’s Wakarusa Wastewater Treatment Plant (WWTP). Jim Sherman, Director of Zoning & Codes, presented the item.
The borrow pit will supply soil exclusively for use during the construction of the WWTP and associated road improvements to E 1600 and N 1175 Roads. Wetland permits have been requested by the City of Lawrence to allow the use of borrow pits on the WWTP site. Once such permits have been approved by the Corp of Engineers, Division of Water Resources and borrow pits are established at the site, it is anticipated the requested activity will cease on the site.
Staff recommends approval of the TBP to allow a borrow pit to be located at the southwest corner of E 1600 Road and N 1175 Road for a period of one year commencing from the date approved by the Board of County Commissioners with the following conditions:
1. BEST MANAGEMENT PRACTICES - The Contractor, its subcontractors, agents, representatives, and any other person carrying on borrowing activities will utilize and employ best management practices in connection with its Borrow Area and related activities.
2. NORMAL HOURS OF OPERATION - Excavation, except as provided below, removal, and transportation of materials from the Borrow Area will only take place between sunrise and sunset, Monday through Saturday, unless the Contractor receives prior written permission from the Zoning & Codes Department. The Zoning & Codes Department shall consider the Contractor’s project schedule, the number of residences near the Borrow Area, and the proximity of those residences to the Borrow Area in determining whether to grant the Contractor such permission.
3. WORK EXCLUSED ON HOLIDAYS - Material will not be excavated, removed, or transported from the Borrow Area on Sundays or holidays unless the Contractor provides the Zoning & Codes Department notice at least 72 hours in advance of the particular Sunday or holiday with a copy of written permission from KDOT to work on said Sunday or holiday. For purpose of this provision, “holidays” are defined as New Years Day, Memorial Day, Fourth of July, Labor Day, Thanksgiving Day, and Christmas Day.
4. ROAD ENTRANCES; CONSTRUCTION AND MAINTENANCE - Any and all entrances to and exits from the Borrow Area shall be constructed and maintained to the standards and specifications established by the Public Works Director/County Engineer.
5. TRANSPORTATION OF MATERIALS AND TARPS - All trucks transporting borrow materials on full-maintenance public roads shall use tarps to securely transport the materials.
6. TRAVEL PLAN ON RECORD AT PUBLIC WORKS - The Contractor shall submit a travel plan describing in detail its complete haul route between the Borrow Area and the Project, said travel plan must be approved by the Public Works Director/County Engineer, and the Contractor shall ensure that all trucks comply with said travel plan. [Only required for hauling on public roads.]
7. MAINTENANCE OF HAUL ROUTE - The Contractor shall, at its own cost and expense, be responsible for: (1) maintaining the haul route described in the travel plan so that it is reasonably free from unsafe driving conditions for the travelling public while hauling operations are ongoing, and (2) repairing and restoring the haul route to pre-haul conditions or better following hauling activities.
8. DUST PALLATIVE ROAD TREATMENT - The Contractor shall, at its own cost and expense, be responsible for providing appropriate dust control measures, as determined by the Public Works Director/County Engineer, on the haul route described in the travel plan throughout the duration of hauling operations. The existence of residences, roadway geometry, traffic volumes and patterns, and roadway surfacing material for the specific haul route will be considered in determining the required dust control measures. As a minimum, it is anticipated dust palliative will be required a minimum distance of 300 feet in either direction in front of any residence along said route.
9. HAUL ROUTE AND TRACKING OF MUD, DIRT AND OTHER DEBRIS UNTO PUBLIC ROADS - The Contractor, any subcontractors, agents, representatives, and any other person carrying on borrowing activities shall not deposit or leave any mud, dirt, or other debris upon the public roads along the haul route described in the travel plan.
10. PROHIBITS USE OF EXPLOSIVES, BLASTING, MINING/QUARRING - The Contractor, its subcontractors, agents, representatives, and any other person carrying on borrowing activities shall not use explosives or blasting to excavate, mine, or quarry the Borrow Area.
11. RECLAMATION OF BORROW SITES - The Borrow Area shall be reclaimed and restored such that the site is able to have established on it and maintain a vegetative surface, free of noxious weeds. A reclamation site plan will be submitted for the site.
12. WATER QUALITY MONITORING – For the purpose of monitoring water quality, a water sample shall, at no expense to the County, be taken from the Borrow Pit and sent to a Kansas Department of Health and Environment (KDHE) certified lab. Such sampling shall occur annually for a period of three years from the approval of the Permit. The Zoning and Codes Department shall be notified of all results.
13. CONSTRUCTION OF BERM – The contractor shall construct a berm along the west and south sides of the Borrow Pit for the purpose of diverting stormwater runoff around the Borrow Pit. The berm shall be constructed and maintained to the standards and specifications established by the Public Works Director/County Engineer and shall be shown on the revised site plan.
14. COMPLIANCE WITH ALL STATE AND FEDERAL LAWS REGARDING BORROW SITES - The Contractor, any subcontractors, agents, representatives, and any other person carrying on borrowing activities shall abide by all Federal and State laws and regulations pertaining to the Borrow Area and related activity.
15. BORROW AREA WITHIN FEMA DESIGNATED FLOODPLAIN AND PERMITS REQUIRED - The Borrow Area, which is located in the FEMA floodplain, shall have all Federal and State Permits issued before applying for and obtaining a local floodplain development permit. No excavating or construction work can commence in a FEMA floodplain without a local Floodplain Development Permit being issued.
16. FIRE SAFETY - Notification shall be given to the Wakarusa Fire Department and the Douglas County Emergency Preparedness Coordinator regarding the proposed operation’s location and startup date prior to commencement of the approved use.
17. HEALTH CODE – Health and sanitation requirements shall be met and facilities, including portable toilets, shall be installed and maintained in accordance with the requirements of the Lawrence-Douglas County Health Department.
18. GENERAL LIABILITY & PROPERTY INSURANCE - A copy of the General Liability & Property Insurance covering this site showing the County as a party held harmless from claims shall be submitted to the Zoning and Codes Department prior to commencement of the approved use.
19. SECURITY LIGHTING – Use of lighting shall require prior written permission from the Zoning and Codes Department except that a security light on the job trailer, as shown on the site plan, shall be allowed and it shall be hooded and aimed away from adjacent properties.
20. REVISED SITE PLAN - All approved conditions shall be shown on the Site Plan. The revised site plan shall be submitted to the Zoning and Codes Department prior to commencement of the approved use.
CL Maurer, Landplan Engineering, stated a neighbor to the site showed up for tonight’s meeting with questions regarding a well issue. Maurer stated he was able to answer the gentlemen’s questions prior to the meeting, so he left.

Thellman moved to approve the Temporary Business permit to allow a borrow pit to be located at the southwest corner of E 1600 Road and N 1175 Road with the above listed conditions as recommended by staff. Motion was seconded by Flory and carried 3-0.
