Man Charged in Pellet Gun Shooting of Brittany Spaniel

Douglas County District Attorney Charles Branson announces a summons to appear in District Court was issued on October 14 for David H. Herren, 65 of Lawrence.  He is charged in the pellet gun shooting death of a Brittany Spaniel named Arlo.  The dog was shot after it came onto his property in the 1700 block of East 1318 Road.  The one count complaint charges Felony Cruelty to Animals for knowingly and maliciously killing an animal.  The statute defines maliciously as an act done with specific intent to do a harmful act without a reasonable justification or excuse.  Herren is ordered to appear in court on November 17 at 3:00 p.m.           

Mr. Herren is presumed innocent until and unless proven guilty. The charge is merely an allegation of criminal conduct.
